Please read the below before renting a rack

The Clothing Space

1. Acceptance of Terms

By purchasing goods, booking, or commencing a rack rental
with The Clothing Space, you acknowledge and agree to these Terms &
Conditions.

References to “we”, “our”, or “us” mean The
Clothing Space. References to “you” or “your” mean the customer/rack
renter.

2. Business Model

The Clothing Space operates a Rent-A-Rack retail
space allowing customers to sell privately owned new and second-hand clothing,
shoes, and accessories.

We provide floor space, point-of-sale processing, and
in-store management of racks.

 

You will be given a Rack space to hang your clothing – we
have hangers available for use – please take your hangers, bags, baskets etc
with you when you are finished setting up your rack.

All stock top-ups must be handed to staff at the counter for
processing. Sellers are not permitted to place items onto racks themselves. We
take care of this for you.

All pricing decisions are the responsibility of the seller.
The Clothing Space does not guarantee sales performance or earnings.

Rack capacity varies depending on garment type and size. We
reserve the right to remove excess items that exceed safe or reasonable rack
limits.

3. Booking & Cancellation Policy

  • A 100%
    deposit is required to secure all rack bookings.
  • Cancellations
    must be made minimum 14 days before the rental start date.
  • Cancellations
    within 14 days and no-shows are non-refundable.
  • Date
    changes may be accommodated at our discretion.

4. Loss, Theft & Damage

While we take reasonable steps to deter theft (including
CCTV surveillance), The Clothing Space:

  • Is not
    liable for stolen, lost, or damaged items.
  • Is
    not responsible for loss caused by fire, water damage, burglary,
    vandalism, or events beyond our control.
  • Does
    not compensate for missing items.

You accept these risks when renting a rack.

We are not liable for business interruption caused by events
beyond our control including fire, flood, pandemic restrictions, power outages,
or natural disasters.

Sellers are responsible for arranging their own insurance
for goods placed in-store if desired.

While our team handles racks with care, The Clothing Space
is not liable for wear, damage, or loss occurring during normal handling,
merchandising, or customer browsing.

5. Sales & Refund Policy

All goods sold in-store and online are community-owned
items.

Therefore:

  • All
    sales are final.
  • No
    refunds or exchanges for change of mind.
  • Customers
    must inspect items prior to purchase.

6. In-Store Conduct & Fair Trading Policy

To ensure fairness to all renters, you must not:

  • Approach
    or pressure customers to buy.
  • Tag
    items yourself inside the store.
  • Promote
    your rack directly to shoppers.
  • Negotiate
    deals with customers.
  • Hover
    near your rack while people browse.
  • Loiter
    to influence sales.
  • Follow
    customers around the store.
  • Touch
    or move other renters’ items.

(Online promotion of your rack is encouraged.)

Breaches will result in cancellation of rental without
refund.

Visual Merchandising

We reserve the right to reorganise racks to maintain store
presentation standards and optimise sales flow. Your rack space may be rotated
during the rental period to optimise store flow and merchandising performance

Rack placement within the store is determined at our
discretion and may change based on store layout, merchandising strategy, or
operational needs.

7. Garment Quality Standards

All items must be:

Freshly washed Free from stains Free from holes/tears Have
working zips/buttons Free from excessive wear

We reserve the right to remove unsellable items. These will
be held in our storeroom for you to collect when your rental period is
complete.

Sellers accept responsibility for ensuring items supplied
are safe, clean, and free from hazards. We are not liable for injury caused by
defective garments or accessories.

8. Pricing & Tagging

All items must be priced and tagged. (unless tagging option
has been selected & paid for ) Example: “Sun Dance Moon – Size 12 –
Brown”

*Your initials + customer number must be on each tag (you
can find your customer number in your booking email)

*Untagged items cannot be sold.

Tagging service available – please select this at checkout
(You must provide us with a list of prices to tag the clothes)

We are not responsible for items incorrectly priced,
mis-tagged, or missing required seller identification

9. Rack Management

Our team will:

  • Organise
    and tidy racks daily
  • Re-merchandise
    items if required

You may top up stock as your items sell, please hand these
to the staff at the front counter. They will then be added to your
rack. 10. Discounting

Rack-wide discounts can be applied upon request.

Discounts must apply to the entire rack, not individual
items.

11. Commission & Payouts

· Sales are paid minus 10% commission – if you
have booked a 0% commission rack no commission will be deducted

Payout occurs within 7 business days after rental
end into your nominated AUSTRALIAN bank account.

Payment is processed after garments are collected or
advised (if you don’t want your remaining items please reach out to
us) Payments made to Australian bank accounts only. Any disputes relating
to sales totals, payouts, or missing items must be submitted in writing within
7 days of the rental period ending.

· The Clothing Space will investigate all disputes using our
Point of Sale (POS) system records, which are deemed the sole and final
authority on all sales transactions.

· Physical price tags, swing tags, or tickets are used for
identification purposes only and do not constitute proof of sale.

· Payments are calculated exclusively from completed
transactions recorded in the POS system. The Clothing Space does not reconcile,
audit, or make payments based on missing, removed, or unaccounted-for tickets.

· It is the seller’s responsibility to ensure all items are
correctly tagged

· Where discrepancies arise between physical tickets and POS
records, POS data will prevail without exception.

· We reserve the right to withhold payouts where Terms are
breached, disputes are unresolved, or identification verification is incomplete

12. Unsold Items & Storage

    contact is made $100 fee will be deducted from your sales and after 7
    days your clothing will be deemed abandoned & will be sold or donated
    at the discretion of the clothing space

13. Donations

You may request unsold items be donated at the end of your
term – please reach out to our friendly team to discuss

14. Social Media & Marketing

By renting a rack, you grant permission for us to:

  • Photograph
    items
  • Promote
    racks on social media
  • Use
    images for marketing

15. Right to Refuse Items We prohibit sale of:

Stolen goods Dirty items Explicit/offensive items Prohibited
items include but are not limited to: • Counterfeit goods • Fast fashion bulk
liquidation stock • Undergarments (unless new with tags) • Offensive or
explicit apparel • Non-clothing items unless approved 16. Limitation of
Liability

To the fullest extent permitted by law, The Clothing Space
is not liable for:

  • Loss
    of income
  • Loss
    of stock
  • Theft
    or damage
  • Business
    interruption

You indemnify and hold harmless The Clothing Space against
any claims, damages, or legal actions arising from goods you supply for sale,
including authenticity disputes, trademark breaches, or ownership claims.

 

17. Governing Law

These Terms are governed by the laws of New South
Wales, Australia.

18. Taxation & Government Reporting

By renting a rack and supplying goods for sale, you
acknowledge that you are responsible for your own tax obligations relating to
any income earned through The Clothing Space.

The Clothing Space does not provide tax advice and does not
withhold tax on your behalf.

You agree that we may be required to provide transaction
records, payout amounts, and customer identification details to the Australian
Taxation Office (ATO) or other government authorities where legally requested
or required to do so.

Customer data is stored securely and used solely for
operational, payment, and compliance purposes.

By entering into a rack rental agreement, you consent to the
collection, storage, and lawful disclosure of this information for compliance
purposes.

Nothing in these Terms excludes rights available under the
Australian Consumer Law where applicable

 

19. Amendments

We reserve the right to update these Terms & Conditions
at any time.
